Terms of Service

These Terms of Service (“Terms”) govern your use of the ArbiBase platform and related services. Please read them carefully before using our website, database, or applications.

1. Acceptance of Terms

By accessing or using ArbiBase services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use our services. Continued use after any update constitutes acceptance of the revised Terms.

2. Services Provided

ArbiBase provides a subscription-based database of verified property leads and educational resources for rental operators. ArbiBase does not:

  • Sign leases or act as an agent on behalf of operators.
  • Guarantee profitability, occupancy, or legal compliance of any property.
  • Manage, co-host, or operate any listed property.

3. User Responsibilities

  • Users must perform their own due diligence and obtain legally binding leases before operating.
  • Users are solely responsible for complying with local, state, and federal laws regarding subleasing, rental arbitrage, and short-term rentals.
  • Users may not share, resell, or redistribute ArbiBase data without written consent.

4. Payments & Refunds

  • Subscription fees are billed monthly or annually via Stripe, PayPal, or other authorized processors.
  • Refunds are available only within 7 days of the first payment for new subscriptions.
  • Annual subscriptions are non-refundable after 30 days.
  • By subscribing, you authorize recurring billing until canceled.

5. Property Verification Disclaimer

While ArbiBase strives to verify property data for accuracy, we do not guarantee that property owners, HOAs, or municipalities will approve subleasing or short-term rental operations. Operators are fully responsible for securing and maintaining direct lease agreements and compliance with applicable regulations.

6. Limitation of Liability

To the maximum extent permitted by law, ArbiBase shall not be liable for any indirect, incidental, or consequential damages, including loss of revenue, business interruption, or reputational harm resulting from use of the platform or reliance on any information provided.

7. Termination of Service

We may suspend or terminate user accounts at our discretion if these Terms are violated or misuse is detected. Upon termination, your access to data and services will cease, but any accrued obligations (e.g., unpaid fees) will survive termination.

8. Governing Law

These Terms shall be governed by and construed under the laws of the United States and the State of Florida, without regard to conflict of law principles.

9. Dispute Resolution

Any disputes shall first be attempted to be resolved informally by contacting ArbiBase support. If unresolved within 30 days, disputes shall be settled through binding arbitration in Miami, Florida, under the rules of the American Arbitration Association. You waive any right to participate in a class action.

10. Changes to Terms

We may update these Terms periodically. The date at the top of this page reflects the latest revision. Continued use of the Services after any update constitutes acceptance of the revised Terms.
